SmartPhoneValidator provides phone number validation, verification, enrichment, and telecommunications intelligence services designed to improve contact data quality, communication efficiency, compliance efforts, and operational performance. The Services may include real-time phone number validation, bulk phone number verification, phone validation APIs, carrier and line-type identification, E.164 formatting and standardization, geolocation and timezone intelligence, disposable number detection, TCPA litigator screening, integrations, automation tools, and other related data quality services. The Services are continuously evolving, and SmartPhoneValidator reserves the right to modify, enhance, suspend, discontinue, or replace any feature, functionality, or component of the Services at any time without liability. While we strive to maintain high levels of service availability and performance, we do not guarantee uninterrupted access to the Services and may perform maintenance, upgrades, or infrastructure changes as necessary.
6. User Obligations
You agree to use the Services responsibly and solely for lawful purposes. You are responsible for ensuring that you possess all necessary rights, permissions, notices, and lawful bases required to collect, process, transmit, and use any phone numbers, personal information, or other data submitted through the Services. You acknowledge that SmartPhoneValidator acts solely as a technology and data quality service provider and does not determine how customers collect, store, or utilize information. Compliance with applicable privacy laws, telecommunications regulations, anti-spam laws, consumer protection requirements, TCPA obligations, marketing regulations, and other legal requirements remains solely your responsibility.
7. Prohibited Conduct
You may not use the Services in any manner that violates applicable laws, regulations, or third-party rights. Prohibited activities include, without limitation, unauthorized telemarketing, robocalling, spam campaigns, harassment, unlawful surveillance, fraudulent activity, misuse of telecommunications data, unauthorized access to systems, attempts to reverse engineer the Services, distribution of malware or malicious code, circumvention of security controls, abuse of APIs, excessive automated requests that negatively impact service performance, or any activity intended to disrupt the integrity, security, or availability of the Services. You further agree not to use information obtained through the Services to discriminate against individuals, violate privacy rights, or engage in activities prohibited by applicable law. SmartPhoneValidator reserves the right to investigate suspected misuse and take appropriate action, including suspension or termination of access.
8. Fees and Payment
Certain Services require payment through subscriptions, prepaid credits, enterprise agreements, or other pricing arrangements offered by SmartPhoneValidator. By purchasing or using paid Services, you agree to pay all applicable fees and charges associated with your account. Unless otherwise stated in a separate written agreement, all payments are non-refundable and credits have no cash value. Credits may not be transferred, assigned, exchanged, or resold without prior written authorization from SmartPhoneValidator. We reserve the right to modify pricing, billing structures, subscription plans, credit consumption policies, and payment terms at any time. SmartPhoneValidator utilizes proprietary systems, telecommunications intelligence sources, carrier data, public information, and third-party providers to generate validation and enrichment results. Because phone number information may change frequently due to number portability, carrier updates, reassignment, regulatory changes, service cancellations, and other factors beyond our control, we do not guarantee the accuracy, completeness, ownership status, deliverability, legality, availability, or future validity of any phone number or associated information. Validation results are provided on a best-effort basis and should be considered informational in nature. Customers should use validation results as one factor among many when making business, marketing, compliance, or operational decisions.
15. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis without warranties of any kind. To the fullest extent permitted by law, SmartPhoneValidator disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, security, accuracy, reliability, or freedom from errors. SmartPhoneValidator does not warrant that the Services will operate without interruption, that defects will be corrected, or that the Services will be free of viruses, malware, or other harmful components.
16. Limitation of Liability
To the maximum extent permitted by applicable law, SmartPhoneValidator, its affiliates, officers, directors, employees, contractors, licensors, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages arising out of or relating to the use of or inability to use the Services. Upon termination, your right to access and use the Services shall immediately cease. Termination shall not affect any rights or obligations accrued prior to termination, and provisions which by their nature should survive termination shall remain in effect.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India, and you consent to the personal jurisdiction of such courts.
20. General Provisions
These Terms constitute the entire agreement between you and SmartPhoneValidator regarding the Services and supersede all prior or contemporaneous agreements, understandings, communications, and representations relating to the subject matter herein. If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The failure of SmartPhoneValidator to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights. You may not assign or transfer these Terms without our prior written consent, and any attempted assignment in violation of this provision shall be void.
